The health effects of oil and gas drilling and production on neighboring communities

Experts at the University of Colorado School of Public Health's Department of Environmental and Occupational Health completed a review of hundreds of published, peer-reviewed scientific articles to examine what is known concerning the health effects of oil and gas drilling and production on neighboring communities. They also reviewed available empirical data regarding communities in western Colorado. They found that the many hazardous chemicals being used and produced pose a potential health risk for local residents, and recommend a thorough health impact assessment before future expansion of oil and gas activities. Their findings are detailed in these two papers. This work received partial financial support from the Natural Resources Defense Council.

1) According to SMU engineering professor Dr. Al Armendariz, emissions from gas drilling operations in the north Texas region are twice the ozone forming pollution as all the cars in the nine-county ozone non-attainment area.

EPA won't limit rocket fuel in U.S. drinking water

WASHINGTON (AP) — The Environmental Protection Agency has decided there's no need to rid drinking water of a toxic rocket fuel ingredient that has fouled public water supplies around the country.

EPA reached the conclusion in a draft regulatory document not yet made public but reviewed Monday by The Associated Press.

The ingredient, perchlorate, has been found in at least 395 sites in 35 states at levels high enough to interfere with thyroid function and pose developmental health risks, particularly for babies and fetuses, according to some scientists.

The EPA document says that mandating a clean-up level for perchlorate would not result in a "meaningful opportunity for health risk reduction for persons served by public-water systems."

The conclusion, which caps years of dispute over the issue, was denounced by Democrats and environmentalists who accused EPA of caving to pressure from the Pentagon.

Ike Causes Oil Spills in Gulf...Drill Baby, Drill

Hurricane Ike destroys oil platforms in Gulf of Mexico

Hurricane Ike “appears to have destroyed a number of oil production platforms and damaged some of the pipelines in the Gulf of Mexico, federal officials said Sunday.” Lars Herbst, regional director for the Minerals Management Service, said at least 10 production platforms have been destroyed by the storm, and possibly many more. Herbst said, “It’s too early to say if [the impact of Ike is] close to Katrina- and Rita-type damage.” In his advocacy for more offshore oil drilling, John McCain has falsely claimed Hurricanes Katrina and Rita did not “cause significant spillage” and that the platforms “very successfully” survived the impact of the storms. In fact, as the Wonk Room’s Brad Johnson has demonstrated, those hurricanes caused hundreds of oil spills resulting in significant environmental damage.


Yea-yah! Let's drill some more, Baby! And while we're at it, put a biodefense lab right in the Gulf too!

But some warn that by expanding “hydraulic fracturing” of shale, America strikes a Faustian bargain: It gains new energy reserves, but it consumes and quite possibly pollutes critical water resources.

“People need to understand that these are not your old-fashioned gas wells,” says Tracy Carluccio, special projects director for Delaware Riverkeeper, a watchdog group worried about a surge in new gas drilling from New York to Pennsylvania and from Ohio to West Virginia. “This technology produces tremendous amounts of polluted water and uses dangerous chemicals in every single well that’s developed.”


The article singles Texas out:

Besides using vast amounts of groundwater, scientists and environmentalists worry that toxic frac water – 30 percent or more – remains underground and may years later pollute freshwater aquifers.

Millions of gallons of frac water come back to the surface. It could be treated, but in Texas it is most often reinjected into the ground.

Millions more gallons of “produced” water flow out later during gas production. This flow, too, is often tainted with radioactivity and poisons from the shale. Often stored in pits, that waste can leak or overflow while awaiting reinjection.

Simply put: “Each of these wells uses millions of gallons of fresh water, and all of it is going to be contaminated,” Ms. Carluccio says.

“There are numerous instances in various states of surface water and drinking water contamination from hydraulic frac­­turing,” says Kate Sinding, a senior attorney with the Natural Resources De­­fense Council in New York. “Nobody, including the industry, has done any in-depth examination to find out the impact on ground water. We are seeing some bad stuff coming out of individual wells and taps.”


I've posted several accounts about polluted wells.

“EPA produced a final report … that I believe is scientifically unsound and contrary to the purposes of law,” Weston Wilson, a 30-year EPA veteran, wrote in a whistle-blower petition in 2004. “Based on the available science and literature, EPA’s conclusions are unsupportable.”

Today, chemicals used in fracturing are considered by the companies to be trade secrets. The Energy Policy Act of 2005 exempts companies from being forced by the Clean Water Act, Safe Drinking Water Act, and other federal laws to reveal what chemicals are in their fracturing fluids.

But some say that it’s critical to know what’s being injected deep underground.

“We’re very concerned about this toxic drilling and hydraulic fracturing,” says Gwen Lachelt, director of the Oil and Gas Accountability Project in Durango, Colo. “We need to know what’s in what they’re putting into the ground.”

Pipeline Explosion Destroys Two Homes, Injures Five

Gas company talks to families about Appomattox explosion

Updated 5:45 a.m. Tuesday

More than a day after a natural gas pipeline explosion destroyed two homes and injured five people, nearby residents expressed concern that two pipelines are still flowing gas through their community.

Three pipelines run side-by-side between the charred and shattered brick remains of the homes of Linda Jamerson and Calvin Childress along Kelly Creek and Oakville roads in Appomattox County.

The cause of the explosion is still under investigation.

Ike Oil Spills

Texas company reports oil spills where Ike hit

DALLAS — A Texas company estimates it lost more than 1,000 barrels of oil in two spills near where Hurricane Ike struck the hardest on the Texas coast.

Denbury Onshore LLC of Plano has filed initial reports with the Texas Railroad Commission saying 900 barrels of oil were spilled in one location and 143 barrels in another.

Both spills occurred in Chambers County, one of the areas most affected by Ike when it slammed the Texas coast with top winds of 110 mph last weekend.

Texas Railraod Commissions Against Public Interest

In case you missed Brett Shipp's special investigative report last night you can watch the video HERE.

The commissioners side with the oil and gas industry and against citizens again which is no surprise. They voted to grant a permit for an injection well at a very dangerous site on HWY 51. There will be over 100 trucks per day accessing that site.

Texas Third Appeals Court Justices held that "the Commission abused its discretion in failing to consider other factors in determining whether the injection well permit would be in 'the public interest'."


But, hey! They don't care!

Justice Diane Henson went on to say the Commission's "narrow interpretation of 'the public interest' could potentially allow the Commission to rubber stamp injection well permit applications despite legitimate public safety concerns."

Justice Henson, along with all five other justices concurred, sending a strong message to the three Texas Railroad Commissioners.

Were they listening?

This past May when it came time to rule on the proposed injection well in Era, commissioners Michael Williams, Victor Carrillo and Elizabeth Ames Jones voted unanimously to grant the permit and not impede progress being made in the quest for natural gas.

"That would be the Barnett Shale the great source of a lot of good things for that region of this state," said Jones, following the vote last May.

Commissioners declined to discuss their ruling with News 8 but according to their spokesperson and despite the appeals court decision, "The Commission has long maintained it lacks the jurisdiction to address traffic related issues when acting on injection well applications."



Here's Mark's statement:

The true constituents of the current Texas Railroad Commissioners are not the people of Texas. Right now these GOP commissioners, led by my opponent Michael Williams, answer to the big oil and gas corporations. The people have barely been represented by the Commission in its history -- and with the current one-party rule, it's worse than ever. Against the overwhelming opposition of the people of the Era community in Cooke County, Texas Railroad Commissioners are foisting a saltwater injection well on the people -- citing the "public interest" and thereby ignoring the desires of the people.

When Texas Railroad Commissioners take PAC money -- Political Action Committee money -- from big oil and gas corporations, they only hear the arguments from the corporate side, and the current commissioners have proven they will side with their financial backers and against the interests of the people every time. The commissioners are often only seeking higher political office (this is particularly true in the case of Michael Williams).

The public interest is what the public says it is and not what a multinational corporate behemoth says it is. I urge all three current Railroad Commissioners to return all oil and gas PAC money and listen to and obey the people when they say no to a saltwater injection well that could harm the environment and the health of residents -- Texans are serious about protecting their families and their property. It's time the people had someone on the Commission that listens to them and puts the real public interest first.

3. John Davis Voted To Create An Entire State Agency To Protect The Business Interests Of One Of His Big Contributors. John Davis voted to create the Texas Residential Construction Commission by voting for House Bill 730, which helped provide cover and protection from lawsuits for Houston homebuilder Bob Perry, one of Davis’ major contributors. [House Journal, 78th Texas Legislature, Day 56, Record Vote 364, p. 1950].

4. John Davis Puts Corporate Welfare Above Human Welfare. John Davis voted for legislation which created the Texas Enterprise Fund [SB 1771, 77th Texas Legislature], a giant corporate welfare fund administered through the Governor’s office. [House Journal, 78th Texas Legislature, Day 80, Record Vote 778, p. 4559]. But, he voted against helping keep kids out of institutions and voted to continue roadblocks that prevented the elderly and disabled persons from getting Food Stamps. Davis voted against Amendment 25 to CSSB 1, 77th Regular Session, which would have provided appropriations (tied to HB 1213) to establish family-based alternatives to the institutionalization of children who could not remain with their birth parents. This amendment also included a measure to “kill” electronic finger printing for Food Stamp applicants. Electronic finger printing, which cost the state more than $3 million a year is a huge hurdle that the elderly and disabled must overcome to get Food Stamps. And, the program has uncovered relatively little duplication or attempted fraud for the money it costs. [Amendment 25, CSSB 1, (Hse. 2nd Rdg.), House Journal, 77th Texas Legislature, Day 40, Record Vote 126, p. 1065].

5. John Davis Took Money From Lobbyists For Accenture And Passed Legislation To Help Them Privatize Health And Human Services Call Centers. John Davis voted FOR House Bill 2292, the sweeping re-organization legislation that combined 12 HHS agencies into five. [House Journal, 78th Texas Legislature, Day 57, Record Vote 367, p. 1981]. The legislation also: (1) brought about cutbacks in Medicaid benefits and coverage; (2) brought about full-family sanctions to TANF; (3) mandated the use of call centers to determine eligibility for HHS programs, and required private contractors to operate those call centers; (4) gutted the requirement that children in schools and child care facilities must be immunized; (5) defunded the Medically Needy program; (6) provided for “estate recovery,” meaning that the assets of deceased Medicaid patients could be taken by the state to pay for those patients’ care; (7) eliminated income disregards for CHIP; (8) established an asset limit for children in families above 150% FBL within CHIP; (9) provided for a shorter coverage period for CHIP; (10) reduced benefits packages and increased premiums and co-pays; (11) provided the potential for privatization of state schools and state hospitals; (12) eliminated mental health professional services for adults on Medicaid; (14) created a “healthy marriage development program” for TANF recipients.

6. John Davis Took Money From Companies That Run Privatized State Mental Hospitals, And Then Led The Charge To Make It Easy To Privatize Texas' State Schools And Hospitals. John Davis took contributions from Joey Jacobs, CEO of Psychiatric Solutions, and contributions from PSI’s federal and money from PSI’s lobbyist, Marsha M. Jones. He then led the charge to make privatizing state schools and hospitals easy. John Davis introduced Amendments 137 and 138 to House Bill 2292 [House Bill 2292, 78th Texas Legislature, Regular Session] which would have allowed the state to privatize state schools if they could be run at a mere ten percent cost savings [Amendment 137, CSHB 2292, (2nd Rdg.), House Journal, 78th Texas Legislature, Day 56, p. 1923] and privatize state hospitals if they could be run at a mere ten percent cost savings [Amendment 138, CSHB 2292, (2nd Rdg.), House Journal, 78th Texas Legislature, Day 56, p. 1924]. As we've seen with Accenture, privatization doesn't work with health and human services.

7. John Davis Voted To Allow Radioactive Waste To Be Buried In Texas. Davis voted for HB 1567 [House Journal, 77th Texas Legislature, Day 53, Record Vote 316, p. 1713-1714] which allowed for the disposal of low-level radioactive waste from Texas, Maine, and Vermont, within Texas. [Bill Analysis, CSHB 1567, 78th Texas Legislature].

8. John Davis Thinks The Air In Harris County Is Great! John Davis has voted several times against clean air. And, as a matter of fact, Davis actually thinks that air quality in Houston is better than it was 30 years ago: "It's much cleaner than it was 20-30 years ago. I believe we are on the right track. I don't want to choke off industry," he noted in a debate in 2006. John Davis voted against funds for daily “fence-line” monitoring emissions pursuant to Title V of the Clan Air Act. Davis voted to TABLE the amendment, meaning he cast a vote AGAINST clean air. [Amendment 16, CSSB 1, (Hse. 2nd Rdg.), House Journal, 44th Day, 79th Texas Legislature, Record Vote 228, pp. 1453-1454]. John Davis voted to TABLE an amendment to the General Appropriations Act which would have funded Diesel Emissions Reduction Programs. John Davis voted FOR dirty air and AGAINST clean air. [Amendment 98, CSHB 1, (Hse. 2nd Rdg.), House Journal, 46th Day, 80th Texas Legislature, Record Vote 242, pp. 1344-1345]. John Davis Voted Against Clean Air And Against Helping Non-Attainment Areas Improve Air Quality. John Davis voted to TABLE an amendment to the General Appropriations Act which would have required the installation and operation of ambient air quality monitors in non-attainment areas . John Davis voted AGAINST cleaning up the air in his own district! [Amendment 100, CSHB 1, (Hse. 2nd Rdg.), House Journal, 46th Day, 80th Texas Legislature, Record Vote 243, pp. 1346-1347]. All the while John Davis was voting against clean air, he was taking money from Texas' top polluters, including $9,000 from TXU and its PACs. TXU planned to build at least half a dozen smoke-belching coal-fired power plants in Texas, which resulted in a protracted environmental battle before the TXU/KKR merger. Additionally, TXU’s existing Texas power plants rank among the top 50 in the nation in terms of overall pollution and specific pollutants. Davis has also taken money from AEP, which runs the nation’s dirtiest power plant in terms of mercury emissions and is situated in Texas.

9. John Davis Killed Responsible Sex Education. Davis MOVED TO TABLE an amendment to CSSB 1, 79th Texas Legislature, which would have allowed the Department of Health to contract with agencies that provide abstinence-based sexuality education that included information about contraception which was age-appropriate and medically accurate. Davis’ motion resulted in responsible sex education being scuttled. [See House Journal, 79th Texas Legislature, 44th Day, Page 1464]. Davis is also against accountability for abstinence-based sex ed programs. During debate on the General Appropriations Act in 2005, an amendment was proposed which would have required that agencies receiving state funds for abstinence education report back on the programs’ successes at reducing teen pregnancy and sexually transmitted diseases/infections to the Department of Health. That amendment was amended to stipulate that general revenue funds could not be used to compile the reports. Rep. Davis voted AGAINST the amendment as amended on final passage. This was a vote AGAINST accountability in abstinence-based sex education programs. [Amendment 38, CSSB 1, (Hse. 2nd Rdg.), House Journal, 44th Day, 79th Texas Legislature, Record Vote 233, pp. 1464-1466]. John Davis also voted against requiring that family planning service agencies receiving state money be required to abide by federal regulations. Davis voted to TABLE an amendment which would have required any provider receiving a grant of state funds appropriated under the GAA to comply with the Family Planning Policy Manual for Federal Titles X and XX. [Amendment 45, CSSB 1, (Hse. 2nd Rdg.), House Journal, 44th Day, 79th Texas Legislature, Record Vote 234, pp. 1467-1468].

10. John Davis Voted Against Texas Veterans. Davis voted to TABLE an amendment which would have ensured that veterans, their dependents, and survivors, receive all due benefits from the Texas Veterans Commission. [Amendment 23, CSSB 1, (Hse. 2nd Rdg.), House Journal, 44th Day, 79th Texas Legislature, Record Vote 231, pp. 1458-1459].

Photobucket Image HostingJust in time for the election, Brett Shipp brings us another hard hitting investigative report. This time his report covers one of my least favorite subjects: Injection Wells. Need I remind you that drilling waste is regulated by the Texas Railroad Commission?

Last year, Brett exposed Texas Railroad Commissioner negligence and malpractice in his report on the RRC gas coupling inspection failures. Who can forget the first night of his report when Michael Williams, who is seeking reelection to office, refused to talk?

Brett Shipp's investigation into the RRC's cover up of the faulty gas couplings in north Texas probably saved more Texans from a death like Bennie and Martha Cryer's when their home in Wylie, TX exploded due to faulty gas couplings.

Memos from the early 1980s warned gas companies nationwide that the couplings would not meet Federal regulations. The same couplings were used in Minnesota where they took swift action to replace all their faulty couplings. Shipp discovered RRC memos that were covered up and negligence and malpractice in his investigation.


This time Brett’s report focuses on injection wells and the public interest, but I asked this question last year after his coupling report:
How Are Injection Well and Gas Coupling Inspections Alike?

ANSWER: Both inspections are conducted by the Texas Railroad Commission (RRC).


The Railroad Commissioners have been criticized frequently this past year for their conflict of interests. Back in 2006, Williams had taken over $100,000 from energy companies and last year he went to the Super Bowl as the guest of Center Point Energy.

Recently Commissioner Michael Williams, in a reprehensible moment of arrogance, pretended to speak for Dr. Martin Luther King and use King’s name to criticize Senator Obama.

Considering how Williams has enabled environmental injustice against minorities, I want to know where he gets off pretending he knows anything at all about MLK and what he might say or think.


Reverend David Hudson, disabled veteran and citizen of Panola County, Texas, and his entire community has suffered tremendously because Williams has acted as a paid protector of the oil and gas industry rather than serving the public interest. Reverend Hudson issued a nine page Declaration detailing the abuses inflicted upon his community because of Texas Railroad Commissioner malpractice.

Last year I made a wish:

We need Shipp to conduct an investigation into the RRC practices regarding injection well inspections. Injection wells can also cause fatalities. Although, because they don't blow up, death by injection well may not be quite as spectacular. Oh wait! They do blow up!

TPA Round-up

Is Sarah Palin Missing?


According to Time, she won't be giving any interviews. I'd bet she doesn't want to answer any questions about all those lies she told in her speech.

According to Nicole Wallace of the McCain campaign, the American people don't care whether Sarah Palin can answer specific questions about foreign and domestic policy. According to Wallace -- in an appearance I did with her this morning on Joe Scarborough's show -- the American people will learn all they need to know (and all they deserve to know) from Palin's scripted speeches and choreographed appearances on the campaign trail and in campaign ads. The candidates were pressed on their stances on abortion and were even asked what they would do if their own daughters were raped and became pregnant.

Palin said she would support abortion only if the mother's life was in danger. When it came to her daughter, she said, "I would choose life."

Often women are left to raise children on their which is why so many children in America live in poverty. Child support is inadequate and difficult to enforce. Yet, John McCain says women are too dumb for equal pay.

McCain said, after voting against a fair pay bill, that the pay gap isn't due to discrimination. He said that women just need more "education and training."

Obama Fundraising Goes Bonkers After GOP's Day-Long Attack

Proving Sean at fivethirtyeight.com correct, Barack Obama has raised around $8 million since Sarah Palin's speech last night. Better than the $7 million McCain got after the Palin pick was announced. Democrats I've spoken to since the speech have had two reactions, sometimes simultaneously: (1) anger about the fact that their guy got roughed up pretty bad, and (2) fear that the GOP has a new super-effective and super-likeable surrogate. Both emotions lead to the opening of wallets. Maybe Obama doesn't want people to calm down?

Tribute to Reagan on MSNBC!

Yep. A tribute to a man who overthrew 3 democratically elected governments, who formed and funded Central and South American death squads, who allowed the CIA to run drugs to Americans to pay for weapons for the death squads, and who traded with terrorists, as he swapped arms for hostages in Iran.

Let's not forget that Reagan also took our $1 trillion dollar deficit and turned it into $4 trillion. And, in his wisdom, classified ketchup as a vegetable for our kids' school lunch programs. Why feed them real vegetables, when you can feed them mashed up fruit, combined with lots of sugar? What a guy!

Police in St. Paul arrested several journalists yesterday, including Democracy Now! host Amy Goodman and an AP photographer as they were covering protests of the Republican National Convention. And earlier this weekend, police raided a meeting of the video journalists' group I-Witness.
